12/01/2021

Libya – In light of the proposals presented by the Muslim Brotherhood in the dialogue forum and their adherence to the referendum on the constitution, which means disrupting the elections until 2022, 4 political organizations (the Libyan National Movement, the Ihya Libya Party, the Civil Democratic Bloc, and the Young Center Movement) issued a statement in which they warned of these Deliberate procrastination after the UN announcement of the date of the elections on December 24, 2021.

The four political organizations confirmed in their statement, which the Observatory received a copy of today, Tuesday, that the search for a constitutional base for those elections scheduled to take place is already settled, and does not need to open a new debate. This is due to the existence of a constitutional basis ready for those elections (Resolution No. 5 of 2014, and the Constitutional Declaration with its amendments that include the decisions of the February Committee), in order to prevent any delays or additional arguments that continue to deprive the Libyan people of exercising their inherent and legitimate right to choose their leaders and renew the legitimacy in their country.

The statement pointed out that Resolution No. 5 of 2014 is still binding, as it is a valid quorum and an absolute majority, and the legitimate legislative body has not issued anything that invalidates it, pointing out that the constitutional declaration was sufficient to hold Libyan elections twice before in 2012 and 2014, in addition to the February committee being decided for each Issues of separation of powers and clarification of the powers of each.

The political organizations said at the conclusion of their statement: “Everything we have mentioned about further delay enriches us by fabricating fabricated problems with the constitutional rule.”

Statement regarding the constitutional basis for the elections of December 24, 2021

In light of the UN announcement of the date for the Libyan presidential and parliamentary elections on December 24, 2021, and to prevent any delays or additional strife that continue to deprive the Libyan people of exercising their inherent and legitimate right to choose their leaders and renew the legitimacy in their country, we affirm that the search for a “constitutional base” for those elections The decision to be held is an already settled matter that does not need to open a new debate because there is a constitutional basis ready for those elections (which is Resolution No. 5 of 2014, and the Constitutional Declaration with its amendments that include the decisions of the February Committee). From the legitimate legislative body, it is invalidated, and the constitutional declaration was sufficient to hold the Libyan elections twice before, in 2012 and 2014, in addition to the February Committee resolving all issues of separation of powers and specifying the powers of each.

All that we have mentioned about further delays informs us of artificially created problems with the “constitutional rule”.
May God protect Libya, a free, proud, sovereign, united, independent and prosperous state, God Almighty willing.
