Your Excellency, Dear Mr. Kubiš,

Greetings.

As the LPDF catastrophically fails, let us move forward with determination by taking the following recommended URGENT actions:

  1. Block any further attempt by the current Prime Minister and his associates to obstruct the timely direct Presidential and Parliamentarian Elections (24 December 2021 This can be effectively accomplished through taking the following steps:
  1. Urgently publish the results of the UN Sanctions Committee Investigation into the defective process that brought the current Prime Minister to power (the suppressed ‘Appendix 13’ of the last Committee Report). Impunity is the very root of the latest LPDF manipulations.
  • Re-launch that Investigation to look into the dynamics of how the last LPDF session was sabotaged through the fielding of proposals that violated International Law and the local and international consensus on the sanctity of the 24 December date, and how that fielding was even allowed to take place.
  • Seriously look into transferring executive powers to the Deputy Prime Minister until the results of investigations are out. The Prime Minister’s lobby within the LPDF was in clear violation of International Law, and also in violation of the written commitments made by the Prime Minister as he came to power. He violated his commitments to the UN, as well as to the House of Representatives (Decree 1/2021 granting him confidence was clearly time-bound:
    24 December 2021). His access to power and public funds are a direct threat to the timely delivery of the Elections.
  1. Urge the Chairman of the House of Representatives (HoR) to use his Chairmanship purgatives to trigger Decree 5/2014 in combination with Amendment 7 of the Constitutional Declaration, and with reference to the latest UN Security Council Resolutions. That is a solid enough basis for the Presidential and Parliamentarian Elections, without any need for further delay and confusion.
  1. If the Head of the HoR fails to trigger the above juridically-solid package, then urge the UN Security Council to trigger it during its upcoming Session. Since UNSC1970/1973, and as reaffirmed in the last two UNSC resolutions, Libya is still under Chapter 7, and the Elections can be imposed out of respect for the will of the Libyan people (clearly expressed in multiple studies and opinion polls), even as the status-quo kleptocratic clique attempts to obstruct them. Imposing Elections is NOT a violation of sovereignty, but is rather a restoration of sovereignty.
  1. Demonstrate firmness and seriousness by concretely and urgently sanctioning all those who advocate or practice the obstruction of timely Elections. We have already written to you about specific cases, and now you have the newly published list of obstructionists with the LPDF.
  1. Keep pressing ALL foreign forces and mercenaries to urgently leave Libyan soil.
  1. Engage the African Union and the Arab League on the possibility of sending in Teams for Elections-support and Elections-protection.

Delivery of direct Presidential and Parliamentarian Elections on time (24 December 2021) is of existential importance for Libya and Libyans. After
a decade of procrastination and abuse, all patience has run out. As Libyans suffer Covid 19, Power-Cuts, Cash-Shortages, Health-Sector-Collapse, and staggering Inflation, they have every right to choose their own leadership and representatives. The United Nations and all its institutions must stand with the Libyan people, and not with a conceited, corrupt, and expired ruling class.
