Nayed Proposes a Referendum on Five Libyan Constitutional Documents from the “Constitution of 51”

The head of the Ihya Libya, Dr. Aref Ali Nayed, suggested to the Secretary-General of the United Nations to return to the only source of legitimacy, which is the sovereign choice of the Libyan people, according to the principle of self-determination guaranteed in the General Charter of the United Nations, explaining that the presidential or parliamentary elections, which are the genuine and urgent right of the Libyan people. It can only be conducted on a solid constitutional basis on which the Libyan people agree.


In his letter addressed to Guterres, Nayed pointed out that because there is no current consensus on this constitutional basis, and in order to avoid dangerous differences and divisions, we suggest that the United Nations organize and monitor a comprehensive national referendum, indicating that this Libyan constitutional referendum could use the methodology of voting with a hierarchy of preferences (i.e. That every citizen ranks his options from the first to the fifth in preference), whereby every citizen is required to rank his preferences from among five historical Libyan founding documents that are presented as options, namely the 1951 constitution, the 1951 constitution, amended in 1963, the declaration of the establishment of the authority of the people in 1977, the declaration The Constitution of 2011, with the decisions of the February Committee and Resolution 5 of 2014, the draft of the Constituent Body for Drafting the Constitution in 2017
